California Assembly Bill 1340 created a new legal framework for eligible transportation-network-company drivers to organize and bargain collectively while continuing to be classified as independent contractors under state law.
What the law changes
AB 1340 allows covered rideshare drivers to form, join, and participate in driver organizations. A certified organization can bargain with covered transportation network companies over subjects such as compensation, benefits, working conditions, and deactivation procedures.
The law does not automatically make drivers employees. It establishes a state collective-bargaining process designed for qualifying independent rideshare drivers. Delivery-only workers may not be covered in the same way.
Representation is not the same as a completed contract
Reaching a support threshold is one stage. Certification, negotiations, ratification, implementation, and enforcement are separate stages. Drivers should distinguish between a campaign promise, a bargaining proposal, and a benefit contained in a final ratified agreement.
Questions every driver should ask
- Who is eligible to vote and how is driver information protected?
- How are representatives selected and removed?
- Will dues be charged, when would they begin, and who approves them?
- How will part-time, full-time, airport, premium, and multi-app drivers be represented?
- How will a future agreement address compensation, deactivations, benefits, and transparency?
- How can drivers review financial reports and challenge decisions?
