Healthcare Subsidy
Prop 22 promised a healthcare subsidy equivalent to the average contribution under the Affordable Care Act, but access to this benefit is limited by strict requirements set by Uber and Lyft.
- Uber requires drivers to work at least 328 hours per quarter to receive the full benefit of $1,468.62, or 197 hours for $734.31. These thresholds effectively limit access to full-time drivers.
- Lyft offers a subsidy of $734.31 per quarter for those who work an average of 15 hours per week, or the full benefit of $1,468.62 for an average of 25 hours per week.
This raises an important question: What happens to the unclaimed funds for part-time drivers who don’t meet these demanding requirements?
Minimum Earnings Guarantee (120% of Minimum Wage)
Although Uber and Lyft committed to paying drivers 120% of the minimum wage in their respective cities, drivers often report earning less on certain days, leaving many dissatisfied. Despite the guarantee, inconsistencies in earnings persist.
Compensation for Vehicle Expenses
Under Prop 22, Article 1, Section 7448 F, app-based companies are required to compensate drivers for vehicle expenses. Yet, to date, many California drivers report not receiving this promised compensation. Drivers deserve clarity on when and how this benefit will be delivered.
Occupational Accident Insurance for On-the-Job Injuries
While Uber and Lyft promote their $1 million umbrella insurance for car accident protection, drivers struggle to access claims for work-related injuries. The lack of clear,
accessible information on how to file injury claims creates confusion, leaving drivers uncertain about their rights and protections.
Transparency is urgently needed to ensure drivers can utilize this benefit.
Protection Against Discrimination and Sexual Harassment
Drivers do have access to support channels for reporting harassment and discrimination, but many have voiced concerns over slow response times and inconsistent handling of complaints. Furthermore, false rider statements have led to wrongful driver deactivations, compounding frustration.
Drivers are calling for quicker, more accurate responses to these critical issues to ensure their safety and rights on the job.
